Refund & Cancellation Policy
Last updated: 2026-09-18
This Refund & Cancellation Policy explains how the first charge, cancellation and refunds work for a Clocker subscription sold by Smartyn d.o.o. (Croatia), the seller for customers whose billing country is Croatia, another EU member state, the United States, Bosnia and Herzegovina, or Serbia (businesses registered for VAT there). It forms part of, and should be read with, Smartyn's Subscription Terms. The Service itself is provided by Smart Solution Labz LLC (the "Provider") under its Terms & Conditions.
Purchases through Link. Customers in every other country buy from Stripe, as merchant of record, through Link. For those purchases Stripe issues the receipts and handles refunds and chargebacks under Link's terms, and this Policy does not apply; you can still cancel at any time in the web app or through Link.
1. Free trial
The Provider offers a Free Trial of 28 days. No payment card is required to start it, and you are not charged during it. Before it expires you receive a reminder, so the end does not take you by surprise.
If you do not buy a Subscription, access to paid features simply ends when the Free Trial expires - nothing is charged, because nobody holds a payment method for you. Your Workspace and its data are kept for 80 days after expiry, so you can subscribe within that window and continue where you left off. You can stop using the Service at any time during the Free Trial with no cost and no obligation.
If you buy a Subscription during the Free Trial, your card is saved at checkout and nothing is charged until the Free Trial ends: the first charge is made on the day after the last day of the trial, and the checkout shows that date and the amount before you order. We remind you by e-mail 7 days before the first charge, and you can cancel before it at any time, in which case nothing is charged.
2. Subscriptions and automatic renewal
A Subscription runs for an indefinite period and is billed in advance for Billing Periods of 28 days. At the start of each period it renews for that period at the then-current price, unless you have cancelled. The price, the length of the period and the date of the next charge are shown at checkout and in the web app.
Pricing is per user, and the per-user rate depends on your team size (see the table in the Subscription Terms, Section 4). The number of users is counted at the start of each Billing Period and fixes both the tier and the amount for that period; adding or removing users mid-period changes neither the current invoice nor entitles you to a refund, and takes effect at your next renewal.
3. How to cancel
You can cancel your Subscription at any time in the web app, or by e-mail to info@s-labz.com. In the web app the subscription page carries a control labelled "cancel the contract" (in Croatian "raskid ugovora", in German "Verträge hier kündigen"); it leads to a page that shows the end date and what happens to your data, with a final control labelled "confirm the cancellation" (in Croatian "potvrditi raskid ugovora", in German "jetzt kündigen"). Both are available at all times and directly reachable; no further step obstructs or delays the cancellation. After you confirm, we send you a confirmation of receipt by e-mail without delay, stating what you cancelled and the date and time you did so. When you cancel:
- your cancellation takes effect at the end of the current paid Billing Period;
- you keep access to paid features until the end of that period; and
- you will not be charged for any further renewal.
Cancelling stops future charges, apart from what a written custom-feature agreement makes due under Section 14 of the Subscription Terms. It does not, by itself, delete your data: the Provider keeps your Workspace and its data for 80 days after the paid period ends, so you can resubscribe and continue where you left off, unless you asked for erasure when you cancelled, in which case the Provider deletes the Workspace at the end of your contract (Subscription Terms, Section 7). See the Privacy Policy for what happens after that and how to request earlier deletion.
Only the owner of the Workspace can cancel; other Administrators can view billing information.
4. Refunds
General rule (business customers). Because Subscriptions are billed in advance for a set period, payments are generally non-refundable, and cancelling stops future renewals rather than refunding the current period. This is the default for business customers.
When we will consider a refund. We may, at our discretion or where required by law, provide a full or partial refund - for example, if the Service was materially unavailable due to a fault on the Provider's side for a significant period, if you were charged in error or double-charged, or if a renewal was charged despite a timely cancellation. Contact info@s-labz.com and we will review your case fairly.
The introductory price. The introductory price applies, in two steps, to the first 10 paid Billing Periods of a Subscription ordered by day 22 of the Free Trial, on the conditions in the Subscription Terms (Section 6). It cannot be exchanged for money, and its end on the date stated when you bought is neither a price change nor a ground for a refund.
5. Consumers in the European Union: right of withdrawal
If you buy as a consumer (an individual acting outside your trade, business, craft or profession) and are resident in the European Union, you have a statutory right to withdraw from a distance contract within 14 days of the day you ordered, without giving a reason. Clocker is a digital service, so this right applies to a paid Subscription in full: it cannot be waived, and a Subscription that keeps running is never "fully performed" within those 14 days.
We do not ask you to request an earlier start or to accept a proportionate payment: the paid Service starts on the day the Subscription Terms state, and if you withdraw within the 14 days we refund everything you have been charged for the Subscription, in full. If nothing has been charged yet when you withdraw, the order is simply cancelled.
To withdraw, send a clear statement to info@s-labz.com before the deadline (you may, but need not, use the model withdrawal form reproduced at the end of this Policy). We refund the amounts due without undue delay and no later than 14 days after receiving your statement, using the same payment method, unless agreed otherwise.
Croatian consumers keep the same rights under the Croatian Consumer Protection Act, including the 14-day right of unilateral termination with the full refund described above, and the cancellation function of Section 3.
The 14 days run from the day you order, not from the end of the Free Trial. If you subscribe early in the trial, the withdrawal period can end before the first charge is made; after it has passed, cancelling under Section 3 stops every future charge, apart from what a written custom-feature agreement makes due under Section 14 of the Subscription Terms.
6. Consumers in Bosnia and Herzegovina
If you buy as a consumer and are resident in Bosnia and Herzegovina, you may withdraw from the purchase within 15 days of the day you ordered, without giving a reason. We do not ask you to consent to an earlier start, so the right stays with you for the full 15 days; if you withdraw within them, we refund everything you have been charged for the Subscription, in full, to the payment method you used. Send a withdrawal to info@s-labz.com.
7. Customers in the United States
If your billing country is the United States, you can cancel online at any time through the control described in Section 3 or by e-mail; the withdrawal rights of Sections 5 and 6 belong to consumers resident in the European Union and in Bosnia and Herzegovina, and Section 4 governs refunds. The renewal terms, the price after the Free Trial and after the introductory price, and how to cancel are shown at checkout before you pay, repeated in an e-mail you can keep, and reminded 7 days before the first charge and 7 days before the introductory price ends. If we raise the price, you may cancel within 14 days after the first charge at the higher price and receive a pro-rata refund for the unused part of that Billing Period.
8. How refunds are paid
Approved refunds are issued by Smartyn d.o.o. through Stripe to your original payment method. The time for the refund to appear depends on your bank or card issuer. Where a refund concerns an invoice already issued, we issue a credit note.
9. Price changes
If we change Subscription prices, we give you notice by e-mail at least 30 days before the renewal at which the new price first applies. If you do not cancel before that renewal, the new price applies from it. Where the law of your country requires a different notice window, we follow it (Subscription Terms, Section 8). The end of the introductory price on the date stated when you bought is not a price change.
10. Failed payments
If a renewal payment fails, we retry it, and the Provider may suspend or downgrade access until payment succeeds. If payment is not resolved after the retries, the Subscription is paused and your data is kept for 80 days so that you can resubscribe.
11. Chargebacks
If you believe a charge is wrong, please contact us first at info@s-labz.com so we can resolve it quickly. Initiating a chargeback without contacting us may lead to suspension of the Workspace while the dispute is investigated.
